Terms of Service

These Terms of Service ("Terms") govern your use of DARK SHAN PANEL (the "Service"), operated by Dark Shan Technologies ("we", "us", "our"), based in Main Street, Kamburupitiya, Sri Lanka. By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

DARK SHAN PANEL is a cloud hosting panel that lets you deploy applications from your GitHub repositories onto managed cloud infrastructure, and operate them (logs, restarts, scaling, domains, files) from a web dashboard. We provide the platform; you are responsible for the applications you deploy.

2. Accounts

• You sign in using your GitHub account. You are responsible for everything that happens under your account.
• You must provide accurate information and keep your GitHub account secure.
• You must be at least 16 years old to use the Service.
• One person may not maintain multiple accounts to abuse free allowances or evade limits.

3. Plans, Credits & Billing

• The Service is billed through prepaid credit packs ("Plans"). Prices and credit amounts are shown on our pricing section at the time of purchase.
• Each Plan is valid for 30 days from purchase. Unused credits expire when the plan window ends.
• Running applications consume credits per hour based on their dyno size, as published in the documentation.
• When your balance can no longer cover an app's hourly charge, that app is suspended. Topping up automatically resumes suspended apps.
• Plans are one-time purchases — we do not auto-renew and we do not store your card details.

4. Payments

• Payments are processed by third-party payment-gateway partners that are licensed and PCI-DSS compliant.
• You authorize us to charge the payment method you provide for the plan you select.
• Prices are listed in USD unless stated otherwise; your bank may apply its own conversion rate and fees.
• Refunds are governed by our Refund Policy.

5. Acceptable Use

You agree NOT to use the Service to deploy or run anything that:

• breaks any law or regulation (Sri Lankan or otherwise), or infringes others' intellectual property;
• is malware, phishing, spam, or designed to attack, probe or disrupt other systems;
• mines cryptocurrency, runs DDoS tools, or abuses shared infrastructure;
• hosts adult, gambling or other content prohibited by our payment partners;
• attempts to bypass billing, rate limits or security controls.

We may suspend or terminate apps and accounts that violate these rules, with or without notice, and without refund for credits consumed by abusive workloads.

6. Your Content & Applications

• You keep all rights to the code and content you deploy.
• You grant us the limited rights needed to build, run and display your applications as part of providing the Service.
• You are responsible for backups of your own data and code.

7. Service Availability

We work hard to keep the Service fast and reliable, but it is provided "as is" and "as available". We do not guarantee uninterrupted availability, and we may change, suspend or discontinue features with reasonable notice where practical.

8. Limitation of Liability

To the maximum extent permitted by law, Dark Shan Technologies is not liable for indirect, incidental or consequential damages (including lost profits or data) arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months before the event giving rise to the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or unlawful activity. On termination, your apps are removed and remaining credits are handled per the Refund Policy.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with a new "last updated" date. Continued use after a change means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
